Delivered and Filed: January 16, 2008

DISMISSED FOR WANT OF PROSECUTION

Appellant's brief was initially due on August 9, 2007. On December 17, 2007, we ordered Ms. Hicks, to file her brief and a written response on or before December 31, 2007, reasonably explaining (1) her failure to timely file the brief and (2) why appellee is not significantly injured by her failure to timely file a brief. We warned Hicks that if she failed to file her brief and the written response by the date ordered, we would dismiss the appeal for want of prosecution. Hicks did not respond, nor did she file her brief. The appeal is, therefore, dismissed for want of prosecution. See Tex. R. App. P. 38.8(a)(1), 42.3(b).
